First Statefree Dinner: Politicians commit to standing up for stateless people and including statelessness in the law

The evening of the 22nd of June showed that political participation can take many different forms besides the right to vote.

At our very first Statefree Dinner we had the honor of bringing together members of our Statefree community and politicians from the German Bundestag for the first time. The goals of the evening were to openly discuss the future of statelessness in Germany and, most importantly, to finally close the gap between those who have lived expertise with statelessness and those who have the political power to create positive change.

In a relaxed atmosphere and in a group of 16 people, Statefree Community members and Members of German Bundestag from the SPD, GRÜNE and LINKE as well as their office staff were able to discuss the following questions:

• What has to happen in Germany in order for stateless people to be part of society?
• How do we ensure that law not only remains law and theory but also changes something in the real life of those affected? 

Through the personal experiences that community members shared over the course of the evening, it once again became very clear to everyone present how complex statelessness is and that Germany currently still lacks effective ways to deal with its complexity.

•  “There is a need for a determination procedure [for statelessness]." - Filiz Polat (Member of the German Bundestag, DIE GRÜNEN)

• "Stateless people are often required to provide documents from supposed states of origin, even if these states are affected by wars and other disasters and are unable or unwilling to fulfill their duties. However, these circumstances are not sufficiently taken into account in the authorities and by the legislator, especially with regard to statelessness." - Gökay Akbulut (Member of the German Bundestag, DIE LINKE)

• When talking about the burden of proof and the obligation to cooperate to prove your statelessness "[...] at some point it would have to be said: You have now done everything in your power [to prove your statelessness]. Period. Then an affidavit would have to be signed and [the obligation to cooperate is considered fulfilled]." - Hakan Demir (Member of the German Bundestag, SPD)

The meaningful contributions and perspectives of our community members made the event an inspiring and productive exchange at eye-level. The community's shared barriers, challenges and hopes gave policymakers a concrete insight into what statelessness means for those affected. In the future, they want to share these contributions with other policymakers and convince them that change is urgently needed and long overdue.

Both Hakan Demir and Filiz Polat, as rapporteurs for the citizenship law, promised that they would stand up for the issue of statelessness: 

• "I will work to ensure that statelessness is included in the Nationality Act." - Filiz Polat (Member of the German Bundestag, DIE GRÜNEN)

Among others, politicians Filiz Polat (MdB, GRÜNE), Hakan Demir (MdB, SPD), and Gökay Akbulut (MdB, LINKE) were present. From our community we had the pleasure to welcome Ares Karim, Bahira Maslum Murad, Belal Sadeqi, Karmel Zarzar, Moussa M'Barek and Prince Penaloza.

What happens next? 

The final citizenship law is to be passed in the coming months. For this, the exact text of the law will be negotiated in meetings and readings. Statefree has been in contact with all three governing parties to ensure that they all understand the need for change and are pushing for it at the political level. During the dinner however, it became clear: Statefree's advocacy only did the groundwork; the greatest impact on understanding the issue of statelessness resulted from the direct exchange between politicians and affected people themselves.

After initial skepticism, what remained for our community was a sense of empowerment, of finally being able to share their thoughts directly with decision-makers and being heard as well as seen. There was also a sense of hope that, together with these "new" allies at the political level, perhaps something could change for the better after all.

Statefree Dinner: Politiker*innen setzen sich dafür ein, Staatenlosigkeit ins Gesetz aufzunehmen

Der gemeinsame Abend zusammen mit Staatenlosen und Politiker*innen am 22. Juni hat gezeigt: politische Partizipation kann die unterschiedlichsten Formen haben.
 

Beim allerersten Statefree Dinner hatten wir die Ehre, Mitglieder unserer Statefree Community erstmals mit Politiker*innen aus dem deutschen Bundestag zusammenzubringen. Ziel des Abends war es, gemeinsam über die Zukunft von Staatenlosigkeit in Deutschland zu sprechen und endlich die Lücke zu schließen zwischen denjenigen, die Erfahrung und Expertise haben und denjenigen, die die politische Macht haben, positive Veränderung zu schaffen. 

In vertrauter Atmosphäre und einer Gruppe von 16 Personen konnten Statefree Community Mitglieder und Abgeordnete der SPD, GRÜNE und LINKE sowie deren Büromitarbeiter*innen folgende Fragen besprechen: 

• Was muss in Deutschland passieren, damit staatenlose Menschen Teil der Gesellschaft sein können?
• Wie stellen wir sicher, dass Gesetz nicht nur Gesetz bleibt, sondern auch etwas im Leben von staatenlosen Menschen verändert? 

Durch die persönliche Erfahrungen, die die Community Mitglieder über den Verlauf des Abends teilten, wurde den Politiker*innen noch einmal sehr deutlich, wie komplex Staatenlosigkeit ist und dass es in Deutschland aktuell noch an effektiven Möglichkeiten fehlt, mit dieser Komplexität umzugehen.

•  “Es braucht ein Feststellungsverfahren [für Staatenlosigkeit].” - Filiz Polat (MdB, DIE GRÜNEN)

• “Oft werden von Personen Urkunden aus vermeintlichen Herkunftsstaaten verlangt, auch wenn diese Staaten von Kriegen und anderen Katastrophen betroffen sind und ihren Aufgaben nicht nachkommen können oder wollen. Diese Umstände werden in den Behörden und vom Gesetzgeber jedoch nicht ausreichend berücksichtigt, insbesondere mit Blick auf die Staatenlosigkeit.” - Gökay Akbulut (MdB, DIE LINKE)

• In der Mitwirkungspflicht “[...] müsste irgendwann gesagt werden: Du hast jetzt alles getan, was möglich ist [um deine Staatenlosigkeit zu beweisen]. Punkt. Dann muss eine eidesstattliche Versicherung abgegeben werden und [die Mitwirkungspflicht gilt als erfüllt].“ - Hakan Demir (MdB, SPD)
   

Die aussagekräftigen Beiträge und Perspektiven unserer Community Mitglieder haben die Veranstaltung zu einem inspirierenden und produktiven Austausch auf Augenhöhe gemacht. Die geteilten Hürden, Herausforderungen und Hoffnungen der Community haben den Politiker*innen einen konkreten Einblick gegeben, was Staatenlosigkeit für das Leben der Betroffenen bedeutet. Diese Beiträge möchten sie zukünftig mit anderen Entscheidungsträger*innen teilen und davon überzeugen, dass Veränderung dringend nötig und lange überfällig ist. 

• „Wir brauchen mehr dieser Geschichten. Mehr eurer Geschichten. Damit auch die Politik versteht, warum sich hier etwas ändern muss.“  - Hakan Demir (MdB, SPD)

• “Die Lebensrealität von Staatenlosen zeugt von einem enormen Demokratiedefizit und systematischen Diskriminierungen” - Gökay Akbulut (MdB, DIE LINKE)

Sowohl Hakan Demir als auch Filiz Polat versprachen als Berichterstatter*innen für das Staatsangehörigkeitsgesetz, dass sie sich für das Thema Staatenlosigkeit stark machen werden: 

• “Ich werde mich dafür einsetzen, dass Staatenlosigkeit im Staatsangehörigkeitsgesetz steht.”- Filiz Polat (MdB, DIE GRÜNEN)

Aus der Politik waren unter anderem Filiz Polat (MdB, GRÜNE), Hakan Demir (MdB, SPD), und Gökay Akbulut (MdB, LINKE) anwesend. Aus unserer Community durften wir Ares Karim, Bahira Maslum Murad, Belal Sadeqi, Karmel Zarzar, Moussa M'Barek und Prince Penaloza begrüßen.
 

Wie geht es jetzt weiter? 

In den kommenden Monaten soll das finale Staatsangehörigkeitsgesetz beschlossen werden. Dafür wird in Lesungen und Ausschüssen der genaue Gesetzestext verhandelt. Statefree war mit allen drei Regierungsparteien in Kontakt, um sicherzustellen, dass alle die Notwendigkeit für Veränderungen verstehen und diese auf politischer Ebene vorantreiben. Doch während des Dinners wurde klar: Statefrees Interessenvertretung hat lediglich die Vorarbeit geleistet, die größte Wirkung auf das Verständnis des Problems hatte der direkte Austausch zwischen Politiker*innen und Betroffenen selbst.

Nach anfänglicher Skepsis blieb für unsere Community vor allem ein Gefühl von Ermächtigung, Entscheidungsträger*innen ihre Gedanken endlich einmal direkt mitteilen zu können und gesehen sowie gehört zu werden. Auch ein Gefühl von Hoffnung stellte sich ein, darauf, dass sich gemeinsam mit den “neuen” Verbündeten auf politischer Ebene nach all diesen Jahren doch vielleicht etwas ändern kann.

Lasst uns als Statefree Community - Staatenlose und Verbündete - alles dafür tun, dass ein Bild ohne Staatenlosigkeit für Staatenlose in Deutschland wieder klarer wird!
